SBA Requests a Delay in Releasing PPP Loan Data

The Small Business Administration (SBA) has asked a judge to delay the release of Paycheck Protection Program (PPP) loan data for millions of borrowers out of concern that such a release would do irreparable harm to some businesses, the Washington Post reported.

The SBA made this request after a Nov. 5 court order mandating that the the names and precise loan amounts of all borrowers, not just the ones with loans over $150,000, be made public by Nov. 19. The judge said that the public interest in knowing what businesses got these funds outweighs private interests in nondisclosure, and he added that the loan applications themselves expressly warned borrowers that their names would be automatically released.

The SBA seeks this delay in order to have more time to determine whether to appeal. The SBA has maintained that releasing the information risks exposing sensitive business information to the public, particularly payroll information that competitors and other parties might be interested in knowing, and that the PPP borrowers would suffer from having that information used against them.
